These Terms of Service (“Terms”) govern your use of the KOTSAF website and purchases made through kotsaf.com.

Throughout these Terms, “KOTSAF”, “we”, “us” and “our” refer to KOTSAF BV.

By accessing our website or placing an order, you agree to these Terms. Please read them carefully before making a purchase.

1. GENERAL

KOTSAF operates an online store offering hair styling, grooming, hair care and related cosmetic products.

By using this website or placing an order, you confirm that you have the legal capacity to enter into a binding agreement or that you are using the website with the permission of your legal representative where required.

We reserve the right to update these Terms where reasonably necessary, including to reflect changes in our services, business practices or applicable law.

The Terms applicable to your purchase are those in force at the time your order is placed, unless mandatory law provides otherwise.

2. PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, sizes, ingredients, characteristics and other information displayed on our website are accurate.

However, minor differences may occur between the appearance of a product on your screen and the physical product, including differences in colour caused by screen settings, photography or lighting.

Product packaging, labels, design or presentation may occasionally be updated without affecting the essential characteristics, function or quality of the product.

For cosmetic and personal-care products, customers should always read the product label, ingredient information, instructions and warnings before use.

3. PRODUCT AVAILABILITY

All products are subject to availability.

Adding a product to your shopping cart does not reserve it.

If a product becomes unavailable after you place an order, we will contact you and, where appropriate, refund the amount paid for the unavailable product.

We reserve the right to discontinue products or modify our product range at any time.

4. PRICES AND VAT

All prices are displayed in the currency indicated on the website.

For consumer purchases, applicable VAT is included or calculated as indicated during the ordering process and in accordance with applicable tax rules.

Any applicable shipping charges will be displayed before the order is completed.

We reserve the right to change our prices at any time. Price changes will not affect orders that have already been accepted by us, except where correction of an obvious pricing or technical error is legally permitted.

If an obvious pricing error occurs, we may contact you before processing the order and give you the option to purchase the product at the correct price or cancel the affected order.

5. ORDERS

To place an order, you must provide accurate and complete information required for processing, payment and delivery.

After placing an order, you will normally receive an electronic order confirmation.

An automated confirmation that we have received your order does not prevent us from rejecting or cancelling an order where there is a legitimate reason to do so.

We may refuse or cancel an order where, for example:

  • A product is unavailable

  • Payment cannot be authorised

  • Information provided is incomplete or incorrect

  • We reasonably suspect fraud or misuse

  • An obvious pricing or technical error has occurred

  • We are legally prohibited from fulfilling the order

If we cancel an order after payment has been received, the corresponding amount will be refunded.

Payment must be successfully authorised before an order can be processed, unless another payment arrangement is expressly offered by KOTSAF.

Payments may be processed by third-party payment service providers. Their own terms and privacy policies may apply to the services they provide.

You are responsible for ensuring that the payment information you provide is accurate and that you are authorised to use the selected payment method.

7. DELIVERY

Orders are delivered to the delivery address provided during checkout.

You are responsible for providing a complete and accurate delivery address.

Available delivery methods, estimated delivery times and applicable shipping charges are displayed during checkout where applicable.

Any delivery date or delivery period communicated by KOTSAF is an estimate unless expressly stated otherwise or mandatory law provides otherwise.

Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier delays, transportation disruptions, severe weather, customs procedures, strikes or other exceptional circumstances.

Your statutory consumer rights regarding delivery remain unaffected.

8. INCORRECT OR INCOMPLETE DELIVERY ADDRESS

Customers are responsible for checking their delivery information before completing an order.

If you discover an error after placing your order, please contact us as soon as possible.

We will make reasonable efforts to assist you, but we cannot guarantee that an address can be changed once an order has been processed or dispatched.

If an order is returned to KOTSAF because the customer provided an incorrect or incomplete delivery address, the customer may be responsible for reasonable additional delivery costs if the order is resent, to the extent permitted by applicable law.

9. RECEIVING AND CHECKING YOUR ORDER

We recommend checking your order promptly after delivery.

If you receive:

  • An incorrect product

  • A damaged product

  • A leaking product

  • A defective product

  • An incomplete order

Please provide your order number and a clear description of the issue.

Where reasonably necessary to investigate the issue, we may ask for photographs of the product, packaging and shipping box.

Nothing in this section limits your statutory rights concerning defective or non-conforming goods.

10. 14-DAY RIGHT OF WITHDRAWAL

If you are a consumer in the European Union or European Economic Area, you generally have the statutory right to withdraw from a distance purchase without giving a reason within 14 days, subject to the exceptions provided by applicable law.

The 14-day withdrawal period generally begins on the day after you, or a third party designated by you other than the carrier, receive the goods.

To exercise your right of withdrawal, you must inform KOTSAF of your decision before the withdrawal period expires by means of a clear statement.

Your communication should preferably include your name, order number and the products you wish to return so that we can process your request efficiently.

After notifying us, you must return the products without undue delay and no later than 14 days after informing us of your decision to withdraw, in accordance with applicable law.

11. COSMETIC, PERSONAL-CARE AND HYGIENE PRODUCTS

KOTSAF sells cosmetic, hair styling, grooming and personal-care products.

Under applicable consumer law, the right of withdrawal does not apply to sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery, where the legal conditions for this exception are met.

Accordingly, if a sealed cosmetic or personal-care product falls within this exception and its seal has been opened or removed after delivery, it cannot be returned under the statutory right of withdrawal merely because you changed your mind.

For this reason, we recommend that you inspect the external packaging and product information before opening or removing any hygiene or protective seal.

This exception does not affect your legal rights if a product is:

  • Defective

  • Damaged

  • Incorrect

  • Leaking

  • Otherwise not in conformity with the contract

Such cases will be handled separately in accordance with applicable consumer law.

12. RETURN CONDITIONS

For eligible change-of-mind returns under the statutory right of withdrawal, products must be returned within the applicable return period.

You are responsible for handling products only to the extent necessary to establish their nature, characteristics and functioning.

You may be responsible for any diminished value of the goods resulting from handling beyond what is necessary for this purpose, in accordance with applicable law.

Where the hygiene exception described above applies, products that have been unsealed after delivery cannot be returned under the right of withdrawal.

Products should be returned securely packaged to prevent damage during transportation.

13. RETURN SHIPPING COSTS

For a valid change-of-mind withdrawal, the customer bears the direct cost of returning the products, unless KOTSAF expressly agrees otherwise or applicable law requires otherwise.

If the product received is incorrect, damaged, defective or otherwise non-conforming due to circumstances for which KOTSAF is responsible, we will provide an appropriate solution in accordance with applicable consumer law.

Please do not send a return without sufficient information allowing us to identify the relevant order.

14. REFUNDS

Where you validly exercise your statutory right of withdrawal, KOTSAF will reimburse the payments received from you in accordance with applicable consumer law.

This includes the cost of our least expensive standard delivery method offered for the original order where reimbursement of that cost is legally required.

If you selected a delivery method that was more expensive than our least expensive standard delivery option, the additional delivery cost does not have to be reimbursed to the extent permitted by law.

We may withhold reimbursement until we have received the returned goods or until you provide evidence that the goods have been sent back, whichever occurs first, where permitted by law.

Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.

Although we process approved refunds promptly, the time required for the funds to appear in your account may depend on your bank, card issuer or payment provider.

15. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

If you receive a product that is damaged, defective, incorrect or otherwise does not conform to your order, please contact:

  • A description of the problem

  • Photographs where reasonably relevant

We will assess the issue and provide an appropriate remedy in accordance with applicable law.

Depending on the circumstances and applicable legal requirements, this may include replacement, refund or another appropriate remedy.

A product does not lose its statutory protection merely because the 14-day change-of-mind withdrawal period has expired.

Nothing in these Terms limits your mandatory statutory rights concerning defective or non-conforming goods.

16. USE OF KOTSAF PRODUCTS

KOTSAF products must be used for their intended purpose and in accordance with any instructions and warnings provided on the product, packaging or website.

Before using a cosmetic or personal-care product, customers should review the relevant product information and ingredient list, particularly if they know they are sensitive or allergic to specific ingredients.

Discontinue use if irritation or an unexpected adverse reaction occurs and seek appropriate professional advice where necessary.

Products should be stored according to the instructions on their packaging and kept out of reach of children where indicated.

To the extent permitted by law, KOTSAF is not responsible for damage caused solely by:

  • Misuse of a product

  • Failure to follow instructions or warnings

  • Improper storage after delivery

  • Use for a purpose for which the product was not intended

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

17. PROMOTIONS AND DISCOUNT CODES

Each promotion may be subject to additional conditions, including:

Unless expressly stated otherwise, discount codes and promotions cannot be combined.

Promotional codes have no cash value and cannot be exchanged for money.

are owned by KOTSAF or used under appropriate rights or licences and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, republish, commercially exploit or otherwise use protected KOTSAF content without prior permission, except where permitted by applicable law.

19. PROHIBITED USE

You may not use the KOTSAF website:

  • For unlawful or fraudulent purposes

To the extent permitted by applicable law, KOTSAF will not be responsible for losses resulting solely from circumstances outside our reasonable control or from the misuse of products contrary to their intended purpose, instructions or warnings.

23. FORCE MAJEURE

KOTSAF will not be responsible for failure or delay in performing an obligation where the failure or delay results from circumstances beyond our reasonable control, to the extent permitted by applicable law.

Such circumstances may include, where applicable:

  • Natural disasters

  • Major transportation disruptions

  • Strikes

  • Government measures

  • Widespread technical failures

  • Exceptional supply-chain disruptions

  • Other unforeseeable events beyond our reasonable control

Where possible, we will take reasonable measures to minimise the impact of such circumstances.

However, if you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protection rights that apply to you under applicable law.
